Sale Method: Registration and sealed bid to be submitted to East Iowa Real Estate by 3:00 P.M. June 29, 2020. Once bids are received the top bid will be posted online at www.eastiowaland.com on the 'Online Auction' tab. Registered bidders will have an opportunity to raise the online bidding through 3:00 P.M., July 1, 2020. If a bid is submitted within 10 minutes of the deadline the bidding will extend another 10 minutes and repeat until bidding ends. Bidding will be no less than $25 increments on per surveyed net acre. Seller reserves the right to accept or reject any or all bids.
Earnest Payment: A 10% NON-REFUNDABLE earnest money payment is required. Once the bidding is ended the successful bidder will enter into a purchase contract with the Seller and pay a 10% earnest payment to be held in East Iowa Real Estate Trust Account.
Property Taxes: Seller to pay estimated real estate taxes pro-rated to closing date.
Conditions: This sale is subject to all easements, covenants, restrictions of record, and tenant's rights. Current tenant has right to farm the cropland for the 2020 season at $243/ crop acre (75.28 acres estimated by FSA). The number of cropland acres will change with the seller keeping part of the farm. There will be a proration of the 2020 rental income to the Buyer at closing based on 73 cropland acres. Farm Service Agency total acres, cropland acres, base acres, etc. are subject to change when farms are split and reconstituted by the Jackson County FSA and NRCS offices. Each bidder is responsible for conducting, at their own risk, their own inspections, inquires, and due diligence concerning the property. The property and fences are being sold on an 'As-Is, Where-Is' basis with no warranties, or guarantees either expressed or implied by the Seller or East Iowa Real Estate. All current and any future fences shall be governed by the Jackson County and State of Iowa fence line rules and regulations.
Contract and Title: The successful bidder, if any, will enter into a purchase contract and deposit with East Iowa Real Estate the required earnest payment. Sale is not contingent on Buyer financing. Final sale is subject to approval of the Seller. The Seller will provide clear title and a certified abstract at Seller expense.
Closing and Possession: Closing to be on or before August 7, 2020 or as agreed between Seller and Buyer. The balance of the purchase price will be payable at closing by certified bank check. Possession at legal closing is subject to tenants rights through 3/1/2021.
